Terms of Service

Javer Webhost, Simple Hosting, and Javer Game Host are in public beta. Features, pricing, and these terms may change as the products develop. We'll do our best to give notice of material changes.

1. Who we are

Javer ("Javer", "we", "us") operates Javer Webhost (panel.javer.pro), Simple Hosting (simple.javer.pro), and Javer Game Host (gamehost.javer.pro) — hosting services for web applications, no-config deploys from GitHub or a zip file, and Minecraft servers respectively. All three share one account via Javer ID. Infrastructure runs on dedicated hardware in Tokyo, Japan.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to create an account and agree to these Terms yourself. If you're younger than that, a parent or legal guardian needs to create the account, agree to these Terms on your behalf, and take responsibility for how it's used.

3. Your account

You need an account to use any of our services. You're responsible for keeping your login credentials secure — we offer two-factor authentication (authenticator app or email code) and strongly recommend enabling it. You're responsible for all activity under your account, including anything deployed through it.

4. Acceptable use

You may not use Javer to host or distribute illegal content, malware, or anything that abuses shared infrastructure (e.g. cryptomining outside your allocated resources, DDoS tooling, spam). Each pricing tier has resource limits (RAM, CPU, storage, number of apps/servers) — we enforce these automatically and may suspend or limit accounts that attempt to circumvent them. We may suspend accounts that violate these terms, with notice where practical.

5. Your content

You own whatever code, data, and content you deploy. We don't inspect the contents of your containers or servers beyond what's needed to operate the service (e.g. resource metering, security incident response). You're responsible for backing up your own data — while we run infrastructure backups for disaster recovery purposes, this isn't a substitute for your own backups of anything you can't afford to lose.

6. Billing

Paid tiers are billed monthly in advance via Stripe. We never see or store your card details — Stripe handles that directly. You can cancel anytime from the Billing page in your panel; cancellation takes effect at the end of your current paid period, and you keep access until then. We don't currently offer partial refunds for unused time in a billing period. If a payment fails, your subscription may move to a past-due state and eventually be canceled, downgrading your account to the free tier — your deployed apps/servers aren't deleted, but you won't be able to create new ones or resize existing ones above the free tier's limits until you're back in good standing.

7. Service availability

This is a beta service running on infrastructure we operate ourselves, not a major cloud provider. We aim for high uptime but don't currently offer a formal SLA or uptime guarantee. We'll post status updates for any significant outage.

8. Termination

You can close your account at any time by contacting [email protected]. We may suspend or terminate accounts that violate Section 4, or that have been inactive with unpaid or past-due balances for an extended period, with notice where practical.

9. Disclaimer of warranties

The Service is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Service will be uninterrupted, secure, or error-free.

10. Limitation of liability

To the extent permitted by law, Javer isn't liable for indirect, incidental, special, or consequential damages arising from your use of the Service, including lost profits or data loss — see Section 5 on backups. Our total liability for any claim relating to the Service is capped at the total fees you paid us in the 3 months before the claim arose, or nothing if you're on the Free tier. Nothing in this section limits liability where it can't legally be limited.

11. Indemnification

You agree to cover our reasonable costs, including legal fees, if a third party makes a claim against us arising from your content, your use of the Service in violation of these Terms, or your violation of any law.

12. Force majeure

We're not responsible for delays or failures caused by events reasonably outside our control, including power outages, internet backbone failures, natural disasters, or government action.

13. Governing law

These Terms are governed by the laws of Japan. Any dispute that can't be resolved directly between us will be handled by the courts with jurisdiction over Tokyo, Japan.

14. General

If any part of these Terms is found unenforceable, the rest still applies. We may transfer these Terms as part of a sale or transfer of the business. These Terms, together with our Privacy Policy, make up the whole agreement between us.

15. Changes

We may update these terms as the product evolves. Material changes will be posted here with an updated date; continued use after a change means you accept the update.
